The Salem County Prosecutor's Office is asking a judge to prevent the Gaudreau brothers’ toxicology reports from being used at the trial of the accused drunk driver who killed them.
Court documents state that Johnny and Matthew Gaudreau were both intoxicated when Sean Higgins allegedly struck them with his vehicle as they rode bicycles. The incident happened in August 2024.
Prosecutors say that Higgins was also intoxicated.
The Gaudreaus were in New Jersey to celebrate their sister’s wedding the next day.
Prosecutors say the brothers’ toxicology reports are irrelevant because there is no law against riding a bicycle while intoxicated.
The brothers were well-known hockey players. Johnny Gaudreau played for the Columbus Blue Jackets at the time of his death.
