A judge has granted possession of a Patchogue home to the family who has been battling to get squatters out for months.

The three-bedroom ranch-style home on Harper Street has been in Kimberly Copenhaver's family for decades. On Friday, a judge ruled that Copenhaver's mother, IIlene Paden, has possession of the house as she is listed as the current homeowner.

Copenhaver says contractor Peter Faiella, who owns Showcase Home Remodeling, was supposed to be watching the house while they were out of the state for a few months. They gave him a set of keys to remove a shed and fix a leak in the roof.

Faiella allegedly rented the home out without the family's consent and has been collecting thousands of dollars a month since February.

The occupants currently living in the home have refused to leave. Under New York state law, squatters become tenants after 30 days.

With the judge's ruling, he also issued a warrant of eviction to the current occupants.

Faiella previously told the court he planned to buy the house and claims he did thousands of dollars' worth of renovations inside, but no receipts or photos were entered as evidence.

Faiella's attorney told News 12 they expect to pursue an appeal and seek damages his client may be entitled to.

Copenhaver, her mother and her son have been staying in a hotel since the court battle began.

The case is due back in court on Jan. 8.
