A federal lawsuit that accused an Orange County horse breeder of filling in wetlands has been dismissed.
Thomas Pushkal and his family own Maplewood Warmbloods, a training and breeding facility in the Town of Wallkill.
The lawsuit also alleged pollution of the Wallkill River during an expansion project.
Pushkal's attorney confirmed the dismissal and noted the federal government is considering narrowing the definition of the Waters of the United States after a U.S. Supreme Court decision.
The U.S. Attorney's Office, which brought the case, could not be reached for comment due to the government shutdown.
