A family announced on Tuesday that they plan to file a lawsuit against a Bronx day care where their baby died.
The Wilson family was joined by their attorney, James Williams, and Rep. Ritchie Torres during the announcement.
Authorities say on Aug. 1, 1-year-old River Wilson was found by police in an above-ground pool at Ana's Butterfly Garden in the Bronx.
Seventy-five days later, the family said they still don't have any answers.
"Forced to grieve in the dark waiting for a phone call with answers that never come," said Ifiok Wison, River's father.
According to police, no arrests have been made.
The Medical Examiner's Office has not yet released a cause of death or an official report.
Attorney James Williams said the family waited long enough for justice to be served.
"The family has tried to let the system work. They tried to let law enforcement move forward. The reality is, the system is failing them right now," said James.
The family announced they are filing a lawsuit.
James said the lawsuit is being filed against the day care owners and the business separately.
"The negligence, gross negligence, the failings that all led to this tragic, untimely, unnecessary death of a child," said the attorney.
The family said this is one step closer to getting justice for their baby girl.
"We will not give up the fight for justice for River," said the father.
