A Sussex County family is moving forward with a lawsuit two years after a badminton racket injury claimed the life of their 6-year-old daughter.
Lucy Morgan died days after suffering a severe head injury while on vacation in Maine.
Her father said a sharp piece of a badminton racket flew off and pierced her skull.
Lucy was flown to a hospital by helicopter after the incident but later died from her injuries.
The lawsuit against Franklin Sports alleges the racket was defective and that the head and metal neck broke off before striking Lucy.
"There are ways that these racquets can be designed so that this type of failure in the racket never happens," attorney Travis Brennan said.
"I don't think anyone can ever recover from the loss of a child," Brennan said.
The family said it hopes the lawsuit will help prevent a similar tragedy from happening to another family.
