Chaos erupted in court Tuesday after 30-year-old Carlos Almanazar Toribio faced new charges in the deadly hit-and-run of an off-duty NYPD officer.
News 12 obtained video last month showing a box truck leaving the scene of a motorcycle crash that killed Jay Pena on the Brooklyn-Queens Expressway.
Sources say the victim's 18-year-old brother attacked an unknown person in the court room. An officer was injured in the struggle.
The defendant was already out of the courtroom when the incident occurred. The 18-year-old was arrested.
Carlos Almanazar Toribio pleaded not guilty to the new charges of leaving the scene of an accident, tampering with evidence and improper display of license plates. He is being held on a $300K bond, $150K cash.
The next court date will be in November.
