The captain of a boat that caught fire near Hart Island is charged with driving while under the influence of alcohol and reckless endangerment.
Joseph Brito, from the Bedford Park in the Bronx, was released from custody after being arrested on June 7
The 33-year-old was driving a charter boat in the Long Island Sound near Hart Island when the boat began to smoke and erupt into flames.
A total of 22 passengers jumped from the boat. Nineteen of them swam to Hart Island for safety, while three others had to be pulled from the water by marine units. One person was seriously hurt, according to fire officials.
Brito told officers he had picked up the group from World's Fair in Queens, and he had one beer, according to court documents. Brito also told officers that he had issues with the boat two days prior to the fire and had disconnected the generator.

Moments later, passengers are seen diving into the Long Island Sound to swim to safety.
FDNY rescue squads were stationed on City Island Avenue near Fordham Street, where the passengers were taken for evaluation.
Brito is due back in court on July 22. The cause of the fire remains under investigation.
