Borough Park landlord, tenant clash over apartment and unpaid rent

A Borough Park landlord says he is battling diabetes and his tenant.
Aniello DeGiuda tells News 12 he is disabled and can no longer safely walk up and down the stairs in his multi-family home. He says he needs to move into the first-floor unit, which is currently occupied by tenant Kenyatta Blakely.
“For me, going up and down the steps is very hard,” DeGiuda said.
But Blakely, who lives in the cellar unit, says he’s not going anywhere and accuses DeGiuda of harassment.
“He tried to file a harassment charge because I’m asking him for the rent, which he hasn’t paid,” said DeGiuda.
Police confirmed Blakely filed a harassment complaint Saturday, citing texts from the landlord that made him feel alarmed.
Blakely says DeGiuda should pursue legal eviction proceedings rather than confront him directly.
“Go to court, Aniello! That is the right way to do this!” Blakely said.
The Department of Buildings says the cellar unit has been under a vacate order since 2022 because it lacks proper lighting and ventilation and was converted into an apartment without permits.
The agency also says someone tore down the vacate notice and taped it back up, a violation that could cost up to $12,500 in fines.
DeGiuda says Blakely has until August to vacate voluntarily, or he will pursue eviction in housing court.
DOB officials tell News 12 the case has been referred to the Office of Administrative Trials and Hearings for further review.
