Video of the incident appears to show two agents in plain clothes rushing up to the door of the vehicle with 28-year-old Oscar Belgal and his 5-year-old son inside.
As the agents approach the vehicle, the car attempts to speed away when one of the agents fires into the driving vehicle.
Another angle of the video appears to show the aftermath after the agents rushed the car and the car crashed.
Belgal was shot in the neck and taken to the hospital. His son was unharmed.
His lawyers say he was being held at a federal jail in Brooklyn with a bullet still in his body.
The Department of Homeland Security says they were conducting a
targeted ICE enforcement operation at around 4 p.m. to apprehend what the agency described as a “criminal illegal alien from the Dominican Republic” who allegedly has multiple prior arrests and gang ties.
