Police first arrested He on Sunday, April 26, after a 27-year-old woman claimed that He put his mouth on her breast while she lay on the massage table earlier that day.
She immediately went to the police and reported the incident.
At the time of his first arrest, He denied the accusation by the woman on Sunday, telling officers, "I only give normal massages. I didn't do anything."
He pleaded not guilty to forcible touching and unauthorized practice of a profession during his initial arraignment on Monday. The judge issued a temporary order of protection and He was released.
According to police, He is also accused of working without a proper license.
Neither He nor the spa appears to be registered under the New York State Office of the Professions database.
This spa has a history with law enforcement.

News 12 has reached out multiple times to the town of Brookhaven for more information on whether the business had ever been shut down, how it was still operating and if the town plans to do anything about it moving forward, but has not yet heard back.
