A Democratic candidate will remain on the ballot in the 17th Congressional District after a court ruling rejected a challenge ahead of the June primary.
State Supreme Court Judge David Fried ruled that Effie Phillips‑Staley had enough valid petition signatures to stay on the Democratic ballot, despite more than 800 signatures being invalidated.
The challenge was filed by Republican Congressman Mike Lawler.
Fried said the Lawler campaign failed to show fraud that was clear and convincing.
In his decision, the judge noted the ruling could be referred to district attorneys in the district if they choose to review it further.
An appeal is expected. The earliest an appellate court could take up the case is May 13.
The Democratic primary is scheduled for June 23.
