News 12 has exclusively learned that a key document related to the candidacy of a controversial Huntington Town supervisor candidate was never submitted.
The Suffolk Board of Elections told News 12 that a candidate cover sheet for Working Families Party candidate Maria Delgado was never filed.
News 12 requested that document after the issue was first flagged to us by elections law expert Paul Sabatino.
Sabatino says the lack of a cover sheet like this one could be considered a “fatal defect” in her candidacy and possibly disqualifying - if Delgado’s opponents had appealed her candidacy with the Board of Elections.
"The one thing that does jump out to me is the cover sheet is missing. The cover sheet would show whether the candidates name or an authorized agent actually signed for the petition that’s attached to the cover sheet," says Sabatino.
Sabatino says that document could have provided proof of whether or not the 83-year-old Delgado was aware of her own candidacy, which has been in dispute.
The Suffolk Board of Elections says that document is not required for Delgado to get on the ballot because her petition is less than 10 sheets.
As News 12 reported, Delgado won the Working Families Party line during a primary and then earned nearly 1,200 voters in the general election.
Republican incumbent Ed Smyth defeated Democrat challenger Cooper Macco by about 600 votes.
