The Department of Justice is taking over the U.S. Department of Education investigation into New York state's mascot ban.
The move comes after Secretary of Education Linda McMahon announced at Massapequa High School that the ban violated the Civil Rights Act.
McMahon threatened to elevate the matter to the DOJ if the state did not rescind the ban on that basis.
The Education Department says the state rejected the agreement twice.
Massapequa did not apply for one.
They have until June 30 to change the mascot. Otherwise, they risk losing state aid.
