An 18-year-old former Newburgh Free Academy student charged with firing into a crowd of teens outside of Newburgh Free Academy’s main campus Tuesday pleaded not guilty on Wednesday and is being held at Orange County Jail on $50,000 cash bail following his arraignment.
Kevin Gaspar, who his attorney says is from the City of Newburgh, appeared in City of Newburgh Court Wednesday morning. Gaspar is facing multiple charges for weapons offenses, tampering with evidence and reckless endangerment.
The former student, whose parents say was recently expelled from the school, is accused of firing multiple shots into a crowd of students at dismissal. His mother and stepfather told News 12 after court that they don’t own any weapons and were unaware of any firearms in the house.
The frightening incident unfolded on Fullerton Avenue and was captured on cellphone video given exclusively to News 12, which shows dozens of young people screaming and running for safety as shots rang out.
“It’s scary and unspeakable. It should never happen,” says one resident who asked not to be identified.
Authorities say the teen was observed with the firearm by an Orange County Sheriff’s School Security Deputy (SSD) who pursued the gunman on foot until he was taken into custody by responding police. No one was hit by the gunfire and the weapon was recovered, police say.
Gaspar’s attorney said inside court that he was assaulted just before the shooting by at least 10 to 15 people outside of the school, who police identify as NFA students.
Newburgh Enlarged City School District officials and City of Newburgh police are working to identify the others involved in that assault and say criminal and disciplinary charges could be filed against them.
Residents News 12 spoke to say they hope the students will be held accountable.
“There’s a lot of kids involved, and I don’t know if they’ll be able to figure out who they are, but those kids should not be in school,” says Newburgh resident David Kenan.
The school district says there’s an increased police presence on campus following the incident and that they’re considering making changes to dismissal plans. Several police vehicles were seen outside of the school during dismissal on Wednesday.
Gaspar’s case will be reviewed by a grand jury on Friday. Full stay-away orders of protection were issued during his arraignment on behalf of two witnesses, including a school security officer.
His mother cried out inside the courtroom when he was brought out in handcuffs and again when the bail amount was set.
Gaspar is due back in City of Newburgh Court Jan. 17.
